SECURITY WARNING

Article 12 of Royal Decree 1205/2011, of August 26, on the safety of toys.

WARNINGS.

  1. When appropriate, for a safe use, the warnings made for the purposes of article 11.2 will specify the appropriate restrictions related to the user, in accordance with Annex V, part A. As regards the categories of toys listed in Annex V, part B, the warnings established in that part will be used. The warnings established in points 2 to 5 of Annex V, Part B, will be used as written in them. The toys will not carry any of the specific warnings contemplated in section 1 if they are in contradiction with their planned use, determined by virtue of their function, dimension and characteristics.
  2. The manufacturer will indicate the warnings clearly and readable, easily understandable and accurate in the toy, on a tag stuck or in the packaging and, if appropriate, in the instructions for use that accompany the toy. Small toys that are sold without packaging will carry the appropriate warnings placed directly on them. The warnings will be preceded by the word "warning" or "warnings," as the case may be. The warnings that determine the purchase decision of the toy, such as those specified by the minimum and maximum ages of the users, as well as the other applicable warnings established in Annex V, will appear in the packaging destined for the consumer or, if not, will be Clearly visible to the consumer before purchase, even when the purchase is made "online."
  3. In accordance with article 5.7, security warnings and instructions will be written at least in Spanish.

WARNINGS

Part A

General warnings

The restrictions on the user contemplated in article 12.1, will include at least the minimum or maximum age of toys users and, where appropriate, their capacity and their maximum or minimum weight, as well as the need to ensure that the toy It is used only under adult supervision.

Part b

Specific warnings and indications of precautions that must be adopted when using some toys categories

  1. Toys not intended for children under thirty -six months.

Toys that may be dangerous for children under thirty -six months will carry a warning, for example, "it is not convenient for children under 36 months", "it is not convenient for children under three years" or a warning with the next pictogram :

These warnings will be accompanied by a brief indication, which may appear in the instructions for use, of the specific danger by which caution is applied.

This point will not apply to toys that manifests, by its functions, dimensions, characteristics, properties or other evident elements, are not likely to be used for children under thirty -six months.

  1. Activity toys.

Activity toys will carry the warning: "Only for domestic use."

Activity toys tied to a crossbar, as well as other activity toys, where appropriate, will be accompanied by use instructions that high soil, etc.) and that need that, in case of omission of these controls, the toy could present a risk of falling or turnaround. Instructions on the correct way to assemble, indicating the parts that may be dangerous in case of incorrect assembly should also be provided. The appropriate surface will be specifically indicated.

  1. Functional toys.

Functional toys will carry the warning: "Use under the direct surveillance of an adult."

In addition, they will be accompanied by instructions for use indicating the precautions that the user must adopt, warning him that in case of omission of said precautions, the hazards will be exposed - which must be specified - characteristic of the device or product of which the toy It constitutes a scale model or an imitation. It will also be indicated that the toy must be kept out of reach of children under a certain age, age that the manufacturer will decide.

  1. Chemical toys

Without prejudice to the application of the provisions established in the applicable community legislation regarding the classification, packaging and labeling of certain substances or mixtures, the instructions for the use of toys containing hazardous substances or mixtures by nature will warn of their danger and They will indicate the precautions that users must adopt to avoid the dangers involved, which must be specified concisely depending on the type of toy. First aid will also be mentioned that must be administered in case of serious accidents that may cause the use of such toys. It will also be indicated that the toy must be kept out of reach of children under a certain age, age that the manufacturer will decide. In addition to the indications cited in the previous paragraph, chemical toys will exhibit the following warning in their packaging: «It is not convenient for children under (*) years. Use under the surveillance of an adult ».

They are considered, in particular, chemical toys: chemistry games, plastic inclusion equipment, ceramic, enameled or photography minitalities and analogous toys that entail a chemical reaction or a similar alteration of the substance during use.

  1. Skates, wheel skates, online skates, skateboards, scooters and toy bicycles for children.

When these products are sold as toys, they will carry the following warning: «It is convenient to use protective equipment. Do not use at places with traffic".

In addition, the instructions for use will remember that the toy must be used prudence, since it requires a lot of skill, to avoid falls or clashes that cause injuries to the user or other people. Some indication will also be given on the recommended protection equipment (helmets, gloves, knee, coders, etc.).

  1. Toys destined to be used in water.

Toys destined to be used in the water will carry the following warning:

"Use only in water where the child can remain standing and under surveillance of an adult."

  1. Food toys.

Toys distributed in food or mixed with food will carry the following warning:

«Contains a toy. An adult surveillance is recommended. "

  1. Toys that mimic masks and protective helmets.

The toys that mimic masks and protective helmets will carry the following warning: "This toy does not offer protection."

  1. Toys destined to be suspended on top of a crib, a park or a stroller for babies through laces, strings, elastic or straps.

The packaging for olfactory board games, cosmetics kit and taste games containing the fragrances contemplated in points 41 to 55 of the list that appears in Annex II, Part III, point 11, first paragraph, and of the fragrances contemplated in points 1 to 11 of the list that appears in the third paragraph of that point will carry the following warning:

"Contains fragrances that can cause allergies."
